1. Acceptance of Terms
This website, www.westshorehomepromos.com (the “Site”), is owned and operated by AdProdigi, LLC (“AdProdigi,” “Company,” “we,” “us,” or “our”).
By accessing or using this Site, or by submitting information through any form on the Site, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Site.
Your use of the Site is also governed by our Privacy Policy.
2. Nature of the Site
The Site is a marketing and lead-generation platform operated by AdProdigi on behalf of West Shore Home®.
By submitting your information through the Site, you are requesting to be contacted regarding home remodeling products and services.
AdProdigi does not perform home improvement services. Information submitted through the Site will be shared with West Shore Home® for purposes of responding to your request.
Submission of information does not guarantee service availability in your location. Services are offered in select areas only.
West Shore Home® is an intended third-party beneficiary of these Terms where applicable.
3. Eligibility
You must be at least eighteen (18) years of age to use this Site.
4. Communications & Consent
By submitting your information through the Site, you consent to receive communications as described in the consent language presented at the time of submission, including marketing communications via telephone, SMS/MMS, email, AI-generated voice, prerecorded voice, or other means.
You understand that consent is not a condition of purchase and that you may withdraw consent at any time using the unsubscribe or opt-out mechanisms provided in communications.
5. No Warranty
The Site and all content and services provided through it are offered on an “as is” and “as available” basis.
AdProdigi makes no warranties, express or implied, regarding the Site’s availability, accuracy, reliability, or suitability for any purpose.
6. Limitation of Liability
To the maximum extent permitted by law, AdProdigi shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your use of the Site.
AdProdigi’s total cumulative liability for any claim arising out of or relating to the Site shall not exceed one hundred dollars ($100).
Nothing in these Terms limits liability that cannot be limited under applicable law.
7. Indemnification
You agree to indemnify and hold harmless AdProdigi and its affiliates, officers, directors, employees, contractors, and agents from any claims, liabilities, damages, and expenses arising out of your misuse of the Site or violation of these Terms.
8. Dispute Resolution – Binding Arbitration & Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
A. Agreement to Arbitrate
You and AdProdigi agree that any dispute, claim, or controversy arising out of or relating to:
• your use of the Site,
• the submission of information through the Site,
• communications resulting from your submission,
• or these Terms
shall be resolved exclusively through final and binding individual arbitration, except as otherwise provided below.
This arbitration agreement is governed by the Federal Arbitration Act (FAA).
B. Arbitration Administrator and Rules
Arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules in effect at the time the dispute is filed.
If AAA is unavailable, the parties shall mutually agree on an alternative provider.
C. Individual Proceedings Only
You and AdProdigi agree that arbitration shall be conducted solely on an individual basis.
You waive any right to:
• participate in a class action,
• act as a class representative,
• join claims with other individuals,
• bring claims in a representative or private attorney general capacity.
The arbitrator shall have no authority to conduct class or consolidated proceedings.
D. Jury Trial Waiver
If for any reason a claim proceeds in court rather than arbitration, you and AdProdigi waive any right to a jury trial.
E. Arbitration Fees
If you initiate arbitration and demonstrate that arbitration costs would be prohibitive compared to court, AdProdigi will pay any filing and arbitrator fees required to prevent arbitration from being cost-prohibitive.
Each party shall bear its own attorneys’ fees unless otherwise required by law.
F. Small Claims Court Exception
Either party may bring an individual action in small claims court if the claim qualifies and remains in that court.
G. 30-Day Right to Opt Out
You may opt out of this arbitration agreement within thirty (30) days of first submitting information through the Site.
To opt out, you must send written notice including:
• Your full name
• The email address and phone number used on the Site
• A clear statement that you wish to opt out of arbitration

If you opt out, you will not be bound by this arbitration section, but all other Terms will remain in effect.
H. Third-Party Beneficiaries
You agree that West Shore Home®, its parents, subsidiaries, affiliates, officers, directors, employees, contractors, and agents are intended third-party beneficiaries of this Dispute Resolution section.
West Shore Home® and such related parties shall have the independent right to enforce this arbitration agreement and class action waiver to the same extent as AdProdigi.
I. Severability
If any portion of this arbitration provision is found unenforceable, the remainder shall remain in effect, except that if the class action waiver is found unenforceable, this entire arbitration section shall be null and void.
J. Governing Law
These Terms shall be governed by the laws of the State of Maryland, except that the arbitration agreement shall be governed by the Federal Arbitration Act.
9. Changes to Terms
AdProdigi reserves the right to modify these Terms at any time. Continued use of the Site after changes are posted constitutes acceptance of those changes.

11. SMS Messaging Program
If you opt in to receive SMS communications, the following terms apply:
You can cancel the SMS service at any time. Just text “STOP” to the short code. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
